Big Setback For Kejriwal-Led AAP In Supreme Court
Currently, the ruling AAP controls 134 seats in the Municipal Corporation, while the BJP holds 104 seats. The MCD has 250 elected and 10 nominated members, with the last MCD polls held in 2022.
In a major setback for Chief Minister Arvind Kejriwal-led Aam Aadmi Party (AAP), the Supreme Court has ruled that the Delhi Lieutenant Governor can nominate aldermen to the Municipal Corporation of Delhi (MCD) without requiring the Delhi government’s advice.
The Supreme Court bench stated that the Lieutenant Governor’s power to appoint members to the MCD is a statutory power and not an executive power. The bench, comprising Chief Justice DY Chandrachud, Justice PS Narasimha, and Justice JB Pardiwala, had reserved its verdict in the matter in 2023.
Justice Narasimha stated that the Lieutenant Governor can appoint 10 persons, not less than 25 years of age, as per Section 3(3)(b) of the Delhi Municipal Corporation Act. The aldermen must have special knowledge or experience in municipal administration.

Chandni Chowk Lok Sabha MP and BJP leader Praveen Khandelwal said the Supreme Court verdict makes it clear that the Lieutenant Governor appointed aldermen as per the law.
