Supreme Court Dismisses Former RG Kar Principal’s Plea Against CBI Probe

The Supreme Court has rejected a petition filed by Sandip Ghosh, the former principal of RG Kar Medical College and Hospital in Kolkata, challenging the Calcutta High Court’s order transferring the investigation into alleged financial irregularities during his tenure to the Central Bureau of Investigation (CBI).
A bench led by Chief Justice of India DY Chandrachud, along with Justices JB Pardiwala and Manoj Misra, dismissed Ghosh’s plea, stating that as an accused, he does not have the legal standing (locus) to intervene in the public interest litigation (PIL) where the Calcutta High Court is monitoring the investigation.
The apex court also refused to remove certain comments made by the High Court linking the corruption allegations against Ghosh with the recent rape and murder of a trainee doctor at the institution on August 9.
The Calcutta High Court had ordered the transfer of the investigation into the alleged financial irregularities at RG Kar Medical College and Hospital, where Ghosh had been the principal since 2021 with a brief interruption, from a special investigation team to the CBI on August 23.
The High Court’s decision came in response to a plea filed by Akhtar Ali, a former deputy superintendent of the medical college, who sought an Enforcement Directorate (ED) investigation into Ghosh’s alleged financial misconduct.
The ED has also registered a money laundering case against Ghosh based on the CBI’s findings and conducted simultaneous search operations at the residences of Ghosh and three of his associates on Friday.
Ghosh, who was arrested by the CBI on September 2, is accused of various crimes, including illegally using bodies for research, unauthorized sale of biomedical waste, and several financial irregularities, such as awarding contracts without proper tenders.
The Supreme Court’s dismissal of Ghosh’s petition marks a significant development in the ongoing investigation into the alleged corruption and the tragic incident at RG Kar Medical College and Hospital.
