The Delhi High Court reaffirmed TMC leader Mahua Moitra’s freedom to defend herself against allegations made by an estranged friend, dismissing a plea seeking to restrain her from making statements deemed defamatory. The court emphasized that Moitra’s defense is permissible as long as her remarks remain factually accurate.
Lawyer Jai Anant Dehadrai filed a lawsuit against Moitra, seeking Rs 2 crore in damages for alleged defamatory statements made amid a cash-for-query controversy. Moitra was expelled from the Lok Sabha following accusations of accepting bribes from businessman Darshan Hiranandani.
Justice Prateek Jalan stressed Moitra’s right to public defense but urged restraint from making objectively false statements. He appealed to Moitra’s “good sense” and advised her counsel to refrain from public comments.
The court highlighted the need for balanced discourse, expressing concern over the parties’ public statements. It cautioned against public defamation and encouraged a more private resolution.
The lawsuit alleges Moitra’s remarks damaged the plaintiff’s reputation, portraying him as embittered and vengeful. The court had previously issued summons on the lawsuit, urging both parties to exercise caution in their public statements.
