The Delhi High Court ruled that government authorities cannot seek recovery of pre-CIRP dues after an insolvency process is completed. In the Jaiprakash Associates case, Customs failed to file its ₹5.89 lakh claim during the CIRP. Citing the IBC, the court said statutory authorities must submit claims during insolvency and cannot later enforce old liabilities.
